wrong sign = lame excuse

I got into a 5 minute argument with this guy who claimed that he could park in the bike lane because there was a No Parking from 6AM-6PM sign here (see photo 1). Yes, that sign shouldn't be there, but no, that does not give him the right to park there. According to the the guy, the sign was put there a few weeks ago. But the bike lane came afterwards. Either way, his excuse is bogus. If there was a a No Parking from 6AM-6PM sign in front of a fire hydrant, could he park there? No.

Parking and driving in bike lanes has been illegal for 30 years and drivers still don't get it, do they?

I'll call 311 or CB2 tomorrow and see if I can get that sign removed.

I am happy to report that this erroneous sign has been replaced with a "No Stopping Anytime" sign, and that there were no cars in the bike lane this evening. Let's hope it stays that way. Thanks DOT!

I'm not so sure this driver was technically wrong.

Traffic rule 4-08(e)(9) on the DOT website states,

"No person shall stop, stand, or park a vehicle in any of the following
places [including a bicycle lane], unless otherwise indicated by posted signs, markings or other traffic control
devices, or at the direction of a law enforcement officer, or as otherwise provided in this
subdivision."

Glad to hear the sign was removed, that could be confusing as the existence of any sign with posted times would indicate that perhaps is ok to park there otherwise.

That being said, common sense would suggest that perhaps a bright green bike lane with no other cars parked there is not a valid spot. Even if the guy wasn't technically wrong (at the time) he's still a jackass with a really lame car.
