Agreed the design is flawed, but unfortunately, something we have to deal with. The automobiles and the cyclists have to share the road and respect each other. When a cyclist breaks the rules of the road it is bad, but when a giant hunk of steel drifts into the lane the city tells us we *have* to bike in, it becomes deadly. So, yes, definitely criticize the design, but by no means excuse drivers who put cyclists needs at risk.
I don't see how it is the MTA bus driver's fault. S/he has a route, they have to follow it. DOT put a bike lane between the bus drivers traveling lane and bus stop. If the bus driver refuses to cross over the bike lane, s/he gets fired. The NYC traffic rules do require a vehicle that must cross a bicycle lane to refrain from doing so in a manner that interferes with the safety and passage of a bicyclists, so there is a theoretical ability for the bus drivers and bicyclists to accomodate each other, but i think I know who will be doing most of the accomodating. I think DOT should be forced to explain what is supposed to be going on in this picture (did you hear that, Santa Claus?)
